FTC

The Federal Trade Commission (FTC) is the US federal agency responsible for consumer protection and enforcement of commercial trade regulations — including email marketing law under CAN-SPAM, online advertising disclosure requirements, data privacy practices, and endorsement and testimonial guidelines for influencer marketing. In the email context, the FTC enforces CAN-SPAM violations: senders using false headers, omitting a physical address, providing a non-functional unsubscribe mechanism, or failing to honor opt-out requests within 10 business days can face civil penalties of up to $51,744 per email, brought by the FTC or by individual state attorneys general. The FTC also issues guidance for digital marketers, including the Endorsements and Testimonials guidelines (requiring disclosure when an endorser has been paid or received free products), and the .com Disclosures guide for digital advertising. FTC enforcement actions are published as public press releases and cover email, influencer marketing, data security, and subscription billing practices.
